Covid Pandemic Requires Remote Depositions For Zantac Cancer Cases In Multidistrict Litigation

"Pursuant to Federal Rule of Civil Procedure 30(b)(4), this Court hereby issues the following protocol to govern any depositions taken in In re: Zantac (Ranitidine) Products Liability Litigation were all, or most, of the primary participants, including the court reporter and videographer, are attending remotely ("Remote Deposition"). The judge confirms the rules of the procedures and that they may have to be altered in the future based on unforeseen circumstances. A remote stenographer will make an official transcript of the depositions and both sides agree that it will be the official record even though the person is not a notary public in the state where the deposition is taking place. A videographer will video record the entire process and no other video of the proceedings is allowed. The court reporter is to be given a copy of the proceedings at the end to verify the accuracy of the transcript. The court reporter will act as an officer of the court and administer the oath to the witness over the teleconference. Another noteworthy deviation from taking in-person depositions is that the judge acknowledges that more time may be needed during teleconferencing sessions and that all parties must be lenient and willing to make adjustments in good faith to facilitate the proceedings as smoothly as possible.
